    On a practical note, if the company has sponsored H1Bs in the past, what justification can the company give for not filing another H1B ?

    Many reasons. Pick any one of you choice.
    1. Employer does not want file H-1B this year at all.
    2. Employer already has 15% workforce on H-1B and does not want to become H-1B dependent employer.
    3. This job is permanent and H-1B can be filed only for temporary jobs.
    H-1B Specialty (Professional) Workers (http://www.foreignlaborcert.doleta.gov/h-1b.cfm) The H-1B program allows an employer to temporarily employ a foreign worker in the U.S. on a nonimmigrant basis in a specialty occupation or as a fashion model of distinguished merit and ability.
    4. H-1B quota is over (if applicable) and employee is on F1 OPT.
    5. In past, many H1-B has been rejected by USCIS for this job position.
    6. The job does not qualify as specialty occupation under H-1B

    All of these reasons are valid legal reasons. One more time, valid legal reasons.


    Practically there are many ways a company can avoid hiring an H1B or GC if they want to. But the point is, as per law that is illegal.

    Are you suggesting the employer is required, by law, to file for H-1B sponsorship for the job applicant?

    Avoiding H-1B applicant is legal, whereas avoiding GC/EAD/OPT applicant isn't.

    For argument sake, assuming if H-1B applicant can force employer to file H-1B and he/she was not picked because of his/her H-1B visa status, he/she has legal route of filing case against that employer. In this was true, there will be many attorneys eager to file such cases. But, alas, there is not even one such case.

    Employer has choice of
    1. Filing or not filing H-1B
    2. Filing or not filing green card for the employee.

    These are employer's choices. Legal choices.

    Yes, if we work on our state chapter and get some idea how many members can join in DC then we can talk about it to core members and see what they think.

    Guys this year's party is pretty much over :rolleyes:....whts the point debating something whether right or wrong which pretty much nobody can do anything about except went frustration from whichever side of the isle one sits on.....

    As per Mr C.O. of USCIS I guess they have sent out the party invitation for the year so I guess there is no point sniping at each other. New inivitations will start from July next yr...;)

    Take a chill pill guys....its a weekend.....get a beer....enjoy life( beleive me GC or no GC these days will not come by:make the most) :D

    My attorney sent my case on 05/31 via Fedex to NSC to reach by 06/01.so far no receipt received per my attorney.she has written the checks for me.I may have to wait and see.

    GCStatus did not mention anything about Labor or I-140 fees here. Nor did he mention, he paid them.

    He refers to all the DOLLARS he has paid for , which means, all EAD and AP renewals ( For self and spouse) , Additional Lawyer fees incase of incorrect NOID, additional Bio-Metrics fees.

    Wait till you hear the actual Lawsuit. Long way to go. But your post helped us to clarify what we are talking about to rest of the folks like you, incase, they misinterpreted the information.

    hi guyz,

    Here u go. The company name is 3i Infotech Inc. based in NJ.

    As far as I know this is a genuine company and not a typical small desi company.
    Did you sign some paper saying that you will reimburse the GC costs if you leave the company? If it was signed before the GC process started then it is not against the law that the company is holding back the $4K. This is a big company and I don't think the $4k matters to them much.

    As far as experience letter, they have to give it.

    Also, sometimes we get mad at the company even though its our own mistake. So, before filling anything with the labor department, make sure you have not signed the papers. By reporting them you are basically giving trouble to others who are in GC process through them.

    Seems that very few people have recieved anything who have filed between 4th and 16th aug.

    Looks like all the applications received till the Friday July 20th got transfered to either Texas or California. Good news is that checks are getting cleared this week. We should be getting receipt soon. Hang in there.

    EB3 Folks!

    This is pathetic ... And it's time for most of you to seriously think about converting to EB2. Now I have no idea how difficult or immpossible this would be, as I had always been EB2, but their are several threads on this forum that can assist you. I strongly suggest you to seriously start researching your way out of this mess. I wan't expecting EB2 to stay beyond 05, but it is going to be like that for another month. Are all the 2004 EB2-I applicants exhausted? ... I don't know, but I know EB3 just keeps on retrogressing.

    If this abyss continues, think about it ... you will always remain struck where you had been for past so many years. This is no life.

    Ask yourselves ... how can I convert to EB2. Take control!

    Here's what the law says:

    8 CFR 204.5(e) relating to PD transfer between eb categories

    (e) Retention of section 203(b) (1), (2), or (3) priority date. A petition approved on behalf of an alien under sections 203(b) (1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b) (1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b) (1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date. A petition revoked under sections 204(e) or 205 of the Act will not confer a priority date, nor will any priority date be established as a result of a denied petition. A priority date is not transferable to another alien.

    Looks like 150,000- 200,000 applications will reach by tommorrow evening and USCIS will stop accepting even if they dont revise visa bulletin.

    And in such case,they will retrogress a lot more than 2003 or 2004 in august bulletin.

    When i have to make my hands wet anyway - how about sending the resignation letter via a Lawyer along with Points that goes against the agreement ?

    That may silence them and it will cost me 2-3 grands hardly - what do you say.

    1. Is there any notice period mentioned in the agreement?
    2. I am not sure if sending resignation letter by lawyer is a good idea. It seems that you hate him big time.
    3. Sending a letter with points against agreement may or may not work. Depends on lot of factors (like how much money they are making thru your contract).
    4. If they sue you, you could lose more than 10,000 (include time and peace of mind).
